These Terms of Use ("Terms") govern use of CareHire (the "Platform"), operated by Caresoft Systems Private Limited, CIN U72900MH2022PTC387875 registered office 311, Mahesh Industrial Estate , Silver Park, Mira Road East , Thane -401107. ("CareHire", "we"). They apply to Job Seekers, Employers and anyone else who uses the Platform.

CAREHIRE IS NEVER FREE-OF-CHARGE FOR EMPLOYERS AND NEVER PAID FOR BY JOB SEEKERS.

We do not charge Job Seekers anything, at any stage, for anything — no registration fee, no profile fee, no application fee, no interview fee, no placement fee. Anyone asking a Job Seeker for money in connection with a job found on CareHire is committing a fraud. Report it immediately to [[email protected]].

We are a platform, not an employer. CareHire does not employ Job Seekers, does not act as an employment agency or recruiting agent, is not a party to any employment relationship, and does not guarantee that any job exists, that any listing is accurate, or that anyone will be hired.

These Terms incorporate the Privacy Policy, Disclaimer and Refund & Cancellation Policy.

1. Definitions

  • "Job Seeker" — an individual using the Platform to find work.
  • "Employer" — a hospital, clinic, laboratory, diagnostic centre, pharmacy, healthcare company or other organisation using the Platform to advertise vacancies or search candidates.
  • "Listing" — a job advertisement posted by an Employer.
  • "Profile" — the information a Job Seeker provides, including resume, qualifications and registration details.
  • "Application" — a Job Seeker's submission of their Profile in response to a Listing.

2. Our Role

  • CareHire provides a venue where Employers advertise vacancies and Job Seekers apply. We facilitate introductions. Nothing more.
  • We are not an employer, an employment exchange, a staffing agency, a manpower supplier, or a recruiting agent, and we do not act on behalf of either side in negotiating terms.
  • We do not screen candidates for an Employer, do not conduct interviews, do not make hiring decisions, and are not party to any offer, contract, bond or termination.
  • In respect of content posted by users, CareHire is an intermediary under the Information Technology Act, 2000.
  • Any dispute about employment, wages, working conditions, notice, bond, termination or conduct is between the Employer and the Job Seeker. We are not a party to it.

3. Eligibility

You must be at least 18 years old and legally able to enter a contract. Employers must be lawfully constituted entities entitled to employ in the jurisdictions where they advertise. You must not use the Platform if we have previously terminated your account for breach.

4. Accounts

  • Provide accurate, current information and keep it updated. Impersonation, false credentials and false employer identity are grounds for immediate termination.
  • Accounts are personal. Do not share credentials. You are responsible for activity under your account.
  • We may require verification of identity, entity registration or qualifications at any time, and may suspend an account pending verification.
  • Notify [email protected] immediately of suspected compromise.

5. Job Seekers

  • Provide truthful information about your qualifications, registration, experience and employment history. Misrepresentation may result in removal and may have consequences with your professional council.
  • Upload only documents that are yours and that you are entitled to share.
  • You control what is in your Profile and may edit, hide or delete it at any time.
  • Applying does not create any obligation on an Employer to respond, interview or hire.
  • You are responsible for satisfying yourself about any Employer before attending an interview, sharing documents or accepting an offer. See §16 and the Disclaimer.

6. No Fees from Job Seekers

CareHire charges Job Seekers nothing, ever, for registration, profiles, applications, visibility, interviews, offers or placement.

No Employer, recruiter, agent or person using this Platform may demand or accept money from a Job Seeker for a job, an interview, training, a uniform, a deposit, document processing, a visa or any other purpose connected with recruitment. Doing so is a fundamental breach, results in immediate and permanent removal, and will be reported to the appropriate authorities.

Job Seekers must never pay anyone for a job found here, and must never hand over original certificates, passports or registration documents before verifying who they are dealing with and receiving a written offer. Report demands for payment to [email protected].

7. Employers

  • You warrant that you are a genuine employer or an authorised representative of one, that every Listing relates to a real, currently available vacancy, and that you have authority to fill it.
  • You must complete verification (§8) before posting.
  • You must respond to applications within a reasonable time and must not keep Listings open for roles that no longer exist.
  • You must comply with all applicable labour, employment, professional-registration, wage, working-hours, contract-labour, maternity and anti-discrimination law.
  • You are solely responsible for verifying a candidate's qualifications, council registration, experience, identity and right to work before employing them (§12).
  • You must not use the Platform to collect candidate data for any purpose other than genuine recruitment (§13).

8. Employer Verification

Before a Listing goes live we verify Employer details — entity name and registration, business address, a working contact, and an identifiable person responsible for the account. We may request additional evidence at any time.

Verification is a check, not a guarantee. It confirms that an organisation exists and that we have reached someone who says they represent it. It is not an assurance about that Employer's conduct, financial standing, working conditions, or that any particular vacancy is genuine. Job Seekers must still exercise their own judgement.

9. Job Listing Standards

Every Listing must state, accurately:

  • the actual employing organisation and the actual place of work;
  • the role, required qualification and any registration requirement;
  • a salary or salary range, or an explicit statement that it is negotiable — figures must be realistic and must not be inflated to attract applications;
  • whether the role is permanent, contractual, locum or temporary, and the shift pattern;
  • whether accommodation, food or transport is provided, if the post says so;
  • whether a service bond, security deposit, or retention of original documents applies — these must be disclosed in the Listing, not revealed after selection.

Listings must not be duplicated, must not advertise the same role repeatedly to appear active, and must not use a Listing to build a candidate database rather than to fill a post.

10. Non-discrimination

Listings must not state or imply a preference based on gender, marital status, pregnancy or intention to have children, caste, religion, ethnicity, region or mother tongue, disability, sexual orientation, or age — except where a genuine occupational requirement applies and is lawful, and the requirement is stated with its reason.

Wording such as "only female candidates", "unmarried preferred", "no married women", "candidates from [community] preferred" is not permitted on this Platform, whatever the practice elsewhere. Such Listings are removed and repeat posting results in account termination.

A genuine occupational requirement — for example a female attendant for a women's ward where the law or patient dignity requires it — must be justified in the Listing. Where you rely on one, you are responsible for its lawfulness.

11. Overseas Jobs and Recruiting Agents

Recruitment of Indian citizens for employment abroad is regulated. Under the Emigration Act, 1983 a person recruiting for overseas employment generally requires a valid Recruiting Agent registration issued by the Protector General of Emigrants, and emigration clearance requirements may apply to the worker.

You must not advertise overseas positions on CareHire unless you hold the required registration and state your registration number in the Listing, or you are the foreign employer recruiting directly in accordance with applicable law. We may require evidence at any time and will remove Listings where it is not produced.

Job Seekers considering overseas roles should verify the recruiter's registration on the official eMigrate portal before parting with any document or money, and should be aware that demands for large fees for overseas nursing and healthcare placements are among the most common recruitment frauds in India.

12. Qualifications and Registration

CareHire does not verify qualifications, degrees, council registration, experience certificates or identity documents. Information in a Profile is provided by the Job Seeker and displayed as given.

Employers are solely responsible for verifying a candidate's credentials — including registration with the relevant nursing, medical, pharmacy, paramedical or allied health council — before employing them, and for any consequence of failing to do so. In healthcare that verification is not optional; it is a patient safety obligation.

Job Seekers must not misrepresent qualifications or registration status. Doing so may amount to an offence and will be reported where appropriate.

13. Use of Candidate Data by Employers

  • Candidate information received through the Platform may be used only to assess and contact that candidate for the role they applied to, or a closely comparable role at your organisation.
  • You must not sell, licence, publish, share with third parties, or add candidate data to a commercial database.
  • You must not use it for marketing, for any purpose unrelated to recruitment, or to contact a candidate about paid services.
  • You must keep it secure, restrict access to those involved in hiring, retain it no longer than needed for that recruitment plus any statutory period, and delete it thereafter.
  • Once you receive a candidate's data you are an independent data fiduciary / controller in respect of it, with your own obligations under applicable data protection law. CareHire is not responsible for what you do with it after delivery.

14. Communications and Consent

  • By registering, you agree to receive service communications — account, application status, security and transactional messages — by email, SMS or WhatsApp. These cannot be opted out of while your account is active.
  • Marketing communications, including job alerts, are sent only with consent and can be turned off at any time from your settings or by using the opt-out in the message.
  • Employers must not use contact details obtained through the Platform to send bulk or promotional messages, and must comply with applicable telecom regulations governing commercial communication, including registration and consent requirements for SMS and voice calls.
  • Repeated unsolicited contact with candidates is grounds for suspension.

15. Prohibited Conduct

You must not:

  • demand or accept money from a Job Seeker (§6);
  • post a vacancy that does not exist, or a Listing for a multi-level marketing, commission-only, investment or "business opportunity" scheme presented as employment;
  • impersonate a hospital, brand, recruiter or individual;
  • post a Listing on behalf of an undisclosed employer;
  • scrape, harvest, bulk-download or automate access to Listings or Profiles;
  • use candidate data outside §13, or resell platform access;
  • post discriminatory, misleading, obscene, defamatory or unlawful content;
  • solicit candidates for anything other than employment — including courses, certifications, loans, visas or coaching;
  • circumvent verification, usage limits or account suspension;
  • probe or test the security of the Platform without written authorisation.

16. Moderation, Reporting and Takedown

  • Anyone can report a Listing, an Employer or a user at [email protected] or through the report link on any Listing.
  • We acknowledge reports within [24] hours and investigate. Where a report alleges a demand for payment from a candidate, or a fraudulent vacancy, we may suspend the Listing and the account immediately, before investigating.
  • We may remove any content that in our reasonable opinion breaches these Terms or the law, and may act on a valid court order, government direction or statutory notice.
  • We may, but are not obliged to, review content. Reviewing some content creates no obligation to review all.
  • We cooperate with law enforcement in respect of recruitment fraud and will preserve and disclose records under valid legal process.

17. Employer Fees and Plans

  • Employer plans, credits, Listing limits, database access and validity are as stated at checkout or in your Order, in Indian rupees, exclusive of GST and other taxes.
  • Credits and plans are prepaid, are valid only for the stated period, and are non-transferable between accounts.
  • Subscriptions renew automatically at the then-current rate unless cancelled before renewal. Price revisions require [30] days' notice, effective at renewal.
  • Refunds are governed by the Refund & Cancellation Policy. No fee is refundable on the basis that a vacancy was not filled — we sell access and visibility, not hiring outcomes.
  • Overdue amounts attract interest at [1.5]% per month or the maximum permitted by law, whichever is lower.

18. Your Content

You retain ownership of everything you post — Profiles, resumes, Listings, logos and descriptions. You grant CareHire a non-exclusive, royalty-free licence to host, store, reproduce, display and distribute it as necessary to operate the Platform, for as long as you keep it posted.

You warrant that you hold the rights required, that your content is accurate, and that it does not infringe any third-party right. We may remove content under §16.

19. Intellectual Property

CareHire and its licensors retain all rights in the Platform, its software, design, taxonomy, databases, documentation and the marks "CareHire" and "Caresoft". You may not copy, extract or reuse any substantial part of our databases. No rights are granted except as expressly stated.

20. Data Protection

Our handling of personal data is described in the Privacy Policy. In summary: CareHire is the data fiduciary / controller for accounts and Profiles; an Employer becomes an independent controller in respect of candidate data it receives (§13); data is stored and processed within India.

21. Availability

The Platform is provided on an "as available" basis. We give no uptime commitment unless a written service level agreement applies. Access may be interrupted for maintenance, security or reasons beyond our control.

22. Warranties

We warrant that we will provide the Platform with reasonable skill and care.

OTHERWISE THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT ANY LISTING IS GENUINE, ACCURATE OR CURRENT; THAT ANY EMPLOYER IS SUITABLE, SOLVENT OR LAWFUL; THAT ANY CANDIDATE'S QUALIFICATIONS, REGISTRATION OR EXPERIENCE ARE AS STATED; THAT ANY APPLICATION WILL RECEIVE A RESPONSE; OR THAT ANY VACANCY WILL BE FILLED OR ANY JOB OBTAINED.

23. Limitation of Liability

23.1 WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, EARNINGS, OPPORTUNITY OR GOODWILL.

23.2 SUBJECT TO 23.3, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU TO US IN THE [TWELVE (12)] MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. FOR JOB SEEKERS, WHO PAY NOTHING, LIABILITY SHALL NOT EXCEED [INR 5,000].

23.3 THE CAP DOES NOT APPLY TO BREACH OF DATA PROTECTION OBLIGATIONS, THE INDEMNITY IN §24, WILFUL MISCONDUCT OR GROSS NEGLIGENCE. [Insert super-cap or state that no cap applies.]

23.4 NOTHING LIMITS LIABILITY FOR FRAUD, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

23.5 We are not liable for the conduct of any Employer or Job Seeker; for money paid by a Job Seeker to anyone; for any employment relationship, its terms, its termination or any dispute arising from it; for a candidate's credentials proving false; for an Employer's treatment of candidate data after delivery; or for any consequence of a job not being obtained or a vacancy not being filled.

24. Indemnity

You will indemnify and hold harmless CareHire and Caresoft Systems Private Limited against claims, losses, liabilities, penalties and costs arising from: your content; your breach of these Terms or of applicable law; for Employers, your recruitment practices, your employment relationships, your use of candidate data, and any discriminatory or unlawful Listing; and for Job Seekers, any misrepresentation of your qualifications or registration.

25. Suspension and Termination

  • You may close your account at any time. Job Seekers may delete their Profile from settings.
  • We may suspend or terminate immediately, without refund, for: demanding money from a Job Seeker; posting fraudulent or non-existent vacancies; misrepresenting identity or credentials; misuse of candidate data; discriminatory Listings after warning; or any other material breach.
  • We may remove content and suspend accounts on a lawful direction.
  • Sections 13, 18, 19, 23, 24 and 26 survive termination.

26. Governing Law and Disputes

Governed by the laws of India. Disputes will first be escalated in good faith for [30] days. Failing resolution, disputes with Employers are finally settled by arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by agreement, seated at [Mumbai, Maharashtra], in English; subject to arbitration, the courts at [Mumbai, Maharashtra] have exclusive jurisdiction.

Nothing in this Section deprives a Job Seeker of any right to bring proceedings in the forum provided by mandatory consumer-protection or labour law applicable to them.
